The National List of Attorneys has arranged to Bond your claims with The Great American Insurance Company.
- This insurance program includes coverage against acts of larceny, embezzlement, fraudulent failure to make accounting or overcharge. This is not a malpractice insurance program.
- This program covers properly registered claims for 36 months and 15 days, from the date of placement. Notification must be sent to The National List of Attorneys, PO Box 2486, Bismarck, ND 58502 within 35 days from the date of employment of an attorney or law firm or be bonded online at www.nationallist.com. The bond notification form shall include the attorney’s name, city and state, amount involved, the name of the creditor and debtor, and the date of sending. This coverage may be extended for an additional 12 months provided The National List of Attorneys receives a written request 90 days prior to the expiration of the original 36 month period and provided the attorney is in good standing and still a member of The National List of Attorneys.
- This program covers listees and claims in all 50 states and Canada, but does not provide coverage on foreign attorneys or foreign claims, including Puerto Rico, Guam, and the Virgin Islands.
- Neither The National List of Attorneys nor the surety shall be liable for any loss through any attorney or law firm whose names were not listed in The National List of Attorneys at the time of employment. It is incumbent upon the forwarder to consult the latest editions and supplements to The National List of Attorneys.
- Recovery under the terms of this Bonding Program shall be net the sum the forwarder would have received had the remittance been made in due course by the attorney or law firm after deduction of costs, expenses, fees and commissions. However, the forwarder is entitled to his normal commission after net attorney remittance.
- Advanced court costs are covered where suit has not been filed.
- The National List of Attorneys and the surety assume no liability for overcharge in connection with suit and/or legal fees unless the amount has been specified in advance and agreed to by the forwarder and the receiving attorney in writing.
- The forwarder, on becoming aware of any act or acts that may be the basis of a claim under this Bonding Program, shall notify The National List of Attorneys immediately and in any event within 60 days thereafter.
- If there is a discrepancy on a remittance by a listed attorney, it is incumbent upon the forwarder to submit to The National List of Attorneys for adjustment the attorney’s check and any other pertinent information to the case. Under no circumstances, should the original check be returned to the attorney for adjustment.
