For Whom the Statute Tolls: Guest Blog

While in law school, students are bombarded with legal doctrines and common law concepts that serve as the backbone of modern law. Lawyers are taught complicated legal fundamentals with archaic Latin names such as “Res Judicata” and “Res Ispa Loquitur.” While I was attempting to learn such foreign principals in law school, I breathed a sigh of relief when we got to the subject of the “Statute of Limitations,” also known as the “SOL.”

The term “Statute of Limitations” is generally familiar to most of our society. The broad and basic meaning of an SOL is also known by most people who have worked in any business setting or who are fans of television legal dramas like Law & Order. A Statute of Limitations is legislated to serve as an absolute bar to initiating legal proceedings for damages, after a determined length of time has elapsed from the event that caused the damages. However, in legal practice the only “absolute” is that nothing in law is simple or absolute.

Meet Your NL Team – Tiffany Thrasher

This is the fifth of our series of introductions to a National List Team Member who gives you the excellent service our members and clients have come to expect. Tiffany Thrasher, NL’s Case Assignment and Compliance Coordinator, is our “Team Member of the Month.” 

Tiffany joined The National List in April of 2013. She had just graduated from Dickinson State University with a bachelor’s degree in Business Administration and a minor in Management, and she had over seven years of customer service experience. She was referred to NL by her good friend and NL employee, Brittany Roe. As the Case Assignment Coordinator of the National List Appearance Counsel (NLAC) Program, Tiffany’s experience helps her to develop strong relationships with the clients and attorney members she works with as she provides qualified appearance counsel to our law firms.

Kaitlyn started working for The National List in Sept. 2011, when she moved to Bismarck to attend college. She was looking for a job that would be part-time with flexible hours and an opportunity for a career after graduation. Working for NL filled all those requirements.

Networking at NARCA

NARCA is one of the best networking conferences in the debt collection industry! My most recent experiences at the Spring NARCA in beautiful, sunny, South Beach Miami, FL, explains why I think so.

One of the most valuable components of NARCA for me is their client meetings. Clients such as Discover, Capital One, TRAK America, Midland and Centerpoint, to name a few, host closed-door meetings with their legal networks. Each is approximately 35 minutes long and focuses on their current status and their future, and highlights some of their top performing firms.  It’s valuable for The National List to attend these meetings, as these are our clients, and the more we understand about their current and future needs, the better we can assist them in building and managing their attorney networks.

CLLA Take-Back: Networking Facilitates Change

“Change” is the buzzword in the debt collection industry, no matter what you read or where you go. But last week, 4/24-26, at the 2014 CLLA Annual Convention in Chicago, National List attendees Leslie Herr and Kacey Rask were impressed with the message that how we get involved and respond to change defines us and has a ripple effect that can bring members of the industry together.

Leslie was a first-timer who is grateful for how welcome she was made to feel. She can’t wait to go again.

This is the third of our introductions to a National List Team Member who will help to give you the excellent service our members and clients have come to expect. Brittany Roe, NL Office Assistant for 8 years, is our “Team Member of the Month.”

Brittany started working for NL on September 5, 2006, when she was just a junior in high school. She took a Co-Op class that gave her credit for working in a professional environment. NL participates in this program, so her teacher knew Randy Nicola and helped her to get a job with us. “It was a great class, because I got credit for going to work, plus a paycheck,” Brittany said. She’s been with us ever since.

All of the printed directory information and more is currently online and is updated daily.

If you are using only our website and see no reason to have a “hard” copy of The NL Directory, then you will be able to help us “Save the Planet” by using the electronically available information, rather than the printed resources.

Here’s a real-life example of how we all tend to do this with other services we’ve spent money on: Our president, Jeff Zuck, recently shared this story. “Early in the year we signed up for Amazon Prime membership, but apparently we have not taken advantage of all this service has to offer. In an email from Amazon, they specifically let me know we have not yet used the “streaming video” that is included in our membership. The interesting thing is that, until this email came, I had no idea we were entitled to free video streaming. Since we have been thinking about getting rid of our traditional cable TV, this was all I needed to push that button. Good-bye cable!”

This is the second of our introductions to a National List Team Member. Because most of our interaction with members and clients is likely to take place on the phone, we think it will help you to feel more comfortable if you have a mental and visual image of us.  Kacey Rask, NL Account Executive for 3.5 years, is our “Team Member of the Month.”

Kacey was born and raised just outside of Whitefish, MT. She attended grades K-12 at Columbia Falls High School, where she was an honors student, swam competitively, played basketball and volleyball and ran track and field. She told me, “Growing up in this area was like being on a vacation. We lived at the base of Big Mountain Ski Resort, hiked in Glacier on the weekends and fished in the many great lakes and streams that flow through this area. I couldn’t have been raised in a more beautiful setting.” Kacey accepted an athletic and academic scholarship to The University of Mary in Bismarck, where she studied business and management, and went on to get an MBA immediately after receiving her undergraduate degree. To all of that, she added student coaching with the U. of Mary track and field team.

Jargon, Acronyms, Abbreviations & Terminology Related to Debt Collection

Almost every profession or industry uses words and expressions that have special meaning related to what they do. These words may take on a different meaning in a specific context than when they are used by the general public. Or they can even be words that apply only to the work of that industry. Such words are often referred to as Jargon. Acronyms and Abbreviations can be part of the unique language or jargon used by members of a specific profession. The legal and debt collection industries are often famous—or infamous—for using terminology not familiar to their clients. Fortunately, there a many resources where anyone can get help, some of them on our own NL website. Let’s lay the groundwork with the “official” definitions of the terms I’ve just used.

Can Debt Collectors Use an Alias?

“Can debt collectors use an alias?” seems like a question with a simple answer, but a little research reveals that it’s not. One complication is that the laws regarding the use of aliases vary from state to state. Here are just a few examples of “opinions” I found that should not be considered legal advice from The National List:

  • Aliases are legal in most states, in fact they are a requirement in California.
